Maharashtra approaches SC against Delhi HC’s move to release arrested activist

The Maharashtra government, which arrested nearly five renowned activists in connection with the highly-sensitive Bhima-Koregaon case, has approached the top court of the country against the Delhi High Court order that has paved the way for the release of activist Gautam Navlakha, one of the five activists who were placed under the house arrest on the order of the Supreme Court.

The advocate who has presented in the Delhi HC for Mr Navlakha has used the wrist of habeas corpus to secure the release of the activist.

This wrist is normally used to secure the release of a person who has been booked over unlawful grounds.

Here, the Maharashtra government argues that there is no justifiable ground to evoke the writ in this case as the arrest has been carried out legally.

On the allegations that the Maharashtra government failed to present the case dairy before the court which were hearing the transit remand petition, the government has tried to justify their stand by saying that the activists were arrested from five different places so it was difficult to present the case diary in all courts which considered the transit remand petitions of the arrested activists.

However, the case gains an unusual attention in the Indian society as a section of Indians still believe that the case is a planned attempt to stifle the voice of aggressive dissent.
