DA Seeks Resentencing for Menendez Brothers, Citing New Abuse Evidence and Evolving Views on Justice

Los Angeles County District Attorney George Gascón announced Thursday he is seeking resentencing for Lyle and Erik Menendez, who were convicted of killing their parents in 1989. Originally sentenced to life without parole, the brothers may face a modified sentence of 50 years to life, allowing for parole eligibility. Gascón noted that because both were under 26 when the crime occurred, they meet criteria for immediate parole consideration under updated justice practices.

Gascón’s decision comes as new evidence emerges, including testimony from a former Menudo band member alleging sexual abuse by José Menendez, the brothers’ father, supporting the Menendez brothers’ initial claims of abuse. The DA argued that the brothers have been rehabilitated and no longer pose a public safety risk. Family members, including José Menendez’s niece, expressed gratitude for the reconsideration, emphasizing the importance of justice and second chances after more than 35 years of incarceration.

The decision is not without opposition; some family members of the victims argue the brothers should remain imprisoned, citing the original motive of financial gain. The case now moves to a Superior Court judge for review, with no hearing date set yet.
