
Three plaintiffs from Tennessee, including two minors, have filed a lawsuit against Elon Musk’s artificial intelligence company, xAI, accusing it of knowingly enabling the creation of sexually explicit content using real individuals’ images. The case, lodged in a federal court in San Jose, California, seeks class-action status on behalf of U.S. individuals who were “reasonably identifiable” in explicit images or videos generated by Grok. The complaint alleges that the AI tool allowed users to manipulate real photos into inappropriate content, sparking serious privacy and safety concerns.
According to the lawsuit, xAI failed to implement adequate safeguards to prevent the generation of sexual content involving minors. The plaintiffs claim their real images were digitally altered into explicit material and circulated online, causing emotional distress and constituting a public nuisance. Notably, all three plaintiffs were minors at the time the alleged content was created. The legal action demands unspecified damages, legal fees, and a court order to halt the alleged practices.
The case comes amid increasing global scrutiny of AI platforms and their content moderation policies. Earlier this year, xAI introduced restrictions blocking users from editing images of real people in revealing clothing or generating such content in jurisdictions where it is illegal, following public backlash. However, the company has yet to respond to the latest allegations. Regulators worldwide have been intensifying efforts to impose stricter safeguards on AI systems to curb the spread of illegal and harmful content.
