Trump’s attorneys argued that Biden’s pardon, which covered both charged and uncharged crimes, echoed Trump’s claims of unfair and selective prosecution, suggesting that he too had been treated unjustly in the legal proceedings against him. The filing demanded that a New York judge nullify the conviction, which found Trump guilty of dozens of felonies related to a cover-up involving hush money payments made during the 2016 election.
Trump’s lawyers contended that the ongoing criminal case threatened to disrupt his presidency, arguing that it violated the Constitution’s provisions for presidential power. They stated that the case should be dismissed due to the significant distractions it posed for Trump’s transition efforts and his preparations for exercising his executive authority. This motion came shortly after Trump’s election victory on November 5, 2024, which they described as an “overwhelming national mandate.” Trump’s attorneys also asked for deferral of all criminal proceedings until after his presidency, which could last until 2029.
