
The U.S. Justice Department has filed fresh criminal charges against former FBI Director James Comey, accusing him of threatening President Donald Trump through a social media post featuring seashells arranged to display the numbers “86 47.” Prosecutors in federal court in North Carolina allege the post constituted a threat against the president and involved transmitting a threat across state lines. The case marks the second time Comey has faced criminal charges amid escalating tensions with Trump and his allies.
The charges stem from an Instagram post shared by Comey in May 2025 during a vacation, which he later deleted after backlash. While “86” can colloquially mean to remove or eject someone, critics argued the combination with “47” — interpreted as a reference to Trump — implied a violent message. Comey has denied any harmful intent, stating he was unaware of such interpretations and emphasizing his opposition to violence. After the post drew scrutiny, he was interviewed by the U.S. Secret Service but initially was not charged.
Legal experts say the case could hinge on interpretations of free speech under the First Amendment, which protects political expression but not direct threats. Comey’s legal team has described the prosecution as politically motivated and vowed to challenge it in court. The case also reflects a broader shift within the Justice Department under new leadership, as it pursues actions aligned with Trump’s calls to investigate perceived political adversaries.
